Terms and Conditions

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. THIS IS A BINDING LEGAL AGREEMENT. BY ACCESSING AND CONTINUING TO USE THE SITE, YOU AGREE TO EACH AND EVERY ONE OF THESE TERMS AND CONDITIONS. PLEASE DO NOT USE THE SITE IF YOU DO NOT AGREE TO EACH AND EVERY ONE OF THESE TERMS AND CONDITIONS.

Online Site Usage

The services of the Site are available only to individuals who can form legally binding contracts under applicable law, and thus, are not available to minors. By using the Site, you represent that you are of sufficient legal age to use the Site and to create binding legal obligations for any liability you may incur as a result of the use of the Sites. You also warrant that you are legally authorized to make the travel reservations and purchases for either yourself or for another person for whom you are authorized to act.

Property Guidelines

CasaELM is a luxury guesthouse available for booking reservations all year round with respect to specific holidays and room availability. Michelle (CasaELM's owner), also lives at CasaELM in the casita to ensure guests are welcomed, well-acquainted, and have a point of contact for any needs while in San Miguel de Allende. We encourage everyone to read the property guidelines before booking a reservation. The property guidelines are in place to ensure the maintenance and preservation of CasaELM and all guests are required to adhere to the following:

  • CasaELM serves to accommodate all guests. Please communicate clearly with us via email, regarding any changes or additions to your reservations. Discuss check-in/check-out times and any special requests well in advance. We require that all guests inform management of additional persons coming to CasaELM prior to travel and arrival dates so that we may charge you accordingly for any amenities that are calculated per person.

  • Please leave the property in the same condition as you found it. Clean up after yourself, and report any damage or issues to your host.

  • Be respectful of your host's privacy and their neighbors. Avoid loud noises and disturbances.

  • Do not invite additional guests without your host's permission.

  • Provide honest and constructive feedback in your review after your stay. This helps future guests make an informed decision when inquiring about booking reservations.

  • Above all, relax, have a great time, and enjoy your CasaELM experience. It's an opportunity to connect with locals and explore new places.

 

Deposits

Please note: CasaELM requires a deposit of up to 50% of the total invoice to secure all reservations. Taxes and fess not included.

For retreat and long term stays, upon receipt of the invoice, guests are required to make deposit payments within 7 days. If the recipient fails to make a deposit and/or pay for services within the stated timeframe(s), CasaELM reserves the right to treat such failure to pay as a breach of contract, voiding the invoice and cancelling the requested services immediately. In such cases, the recipient will forfeit the deposit and any additional payments that have already been processed. CasaELM is not responsible for the recipient's loss of value.

Taxes & Additional Fees

All reservations are subject to a tax of 6% based on the San Miguel de Allende municipal tax authorities. The taxes are added to each line item within your booking reservation before calculating the final total balance due.

Depending on the size of your party, or the event package selected, an administrative fee may be added to your total

 

Cancellation Policy for Booking Reservations & Events

You are able to cancel booking reservations at any time, free of charge. Guests who cancel after making deposits and/or payments toward their reservation will not receive a refund. Please note: Any payments made are nonrefundable. Should you choose to cancel, or reschedule your reservation, the balance paid will be credited and valid for use within 90 days from the date of your original appointment or service. After this 90 day period, the credit will be null and void and you will forfeit the opportunity to redeem it.  Should you choose to check in after scheduled arrival date, or check out before scheduled departure date, we are unable to provide refunds for the changes made to your reservation.

We understand that sometimes plans change, and we are here to assist you in the best possible way. If you need to cancel your reservation, please do so as early as possible to minimize any inconvenience. We understand that unforeseen circumstances may arise, and we are committed to working with you on a case-by-case basis to find the best possible solution for your situation.
